Extracts from The CCMA Rules Including Rules Of Various Courts, 4th Edition
The CCMA rules are intended to expedite the resolution of disputes in a speedy and inexpensive manner and favour the expeditious resolution of disputes on the merits within the framework of the LRA. To achieve the said objective, it is essential that practitioners have available to them the appropriate substantive law applicable to various disputes when appearing before the CCMA. In a new publication, CCMA Rules Including Rules of Various Courts, the author, Dr Brian van Zyl, analyses the substantive law governing various issues that may be relevant when dealing with the different rules of the CCMA. For instance, the substantive law governing the following issues are provided:
- employment relationship (pages 201 to 205)
- collective agreements (pages 207 to 209)
- constructive dismissal (pages 226 to 229)
- benefits disputes (pages 230 to 232)
- unfair suspensions (pages 232 to 235)
- jurisdictional factors (pages 238 to 243)
- grounds of review in terms of s145 of the LRA (pages 254 to 264)
